This document contains the scope of the Personal Data processing policy, which among other things involves processing, collection, retention, storage, administration and deletion of personal data under the responsibility of our company.
Our companies Future World Products and all its affiliated companies are legally incorporated in all LATAM countries where products are marketed, hereinafter ("FWP")
Through this document, we wish to offer the best experience to our users, therefore, we have developed this privacy policy (the "Policy") to inform about the policies and procedures related to the processing of information and personal data collected from our users through the website and/or FWP virtual databases (hereinafter jointly, the "Database").
The Policy described below is aligned with the current regulations on personal data protection laws.
Users who access FWP products agree to abide by the provisions of this Policy, agree that their personal information be collected through questionnaires, registrations, electronic forms, among others granted and/or required virtually in the Database, and authorize FWP to use and process all information provided to FWP.
FWP reserves the right to modify the Policy, which will be communicated via email with reasonable notice prior to its entry into force.
Without prejudice to the terms defined in various sections of this document, the terms used herein with the first letter capitalized and that are not defined otherwise, shall have the meaning attributed to them below, and may be used in masculine, feminine or neutral, as well as in singular or plural, indistinctly and according to context:
Hereinafter, it shall be understood that the expression "Personal Data" shall refer to Personal Information and General Information provided by Users.
If the User wishes to access the products offered by FWP, registration of their Personal Information is required by filling out a form; including: their phone number, email address, full names, a username, a password.
Likewise, User information related to: (i) content shared within the Database, (ii) Comments on products, (iii) payment data, (iv) purchase data is collected. FWP may request other Personal Data that it deems convenient at the time.
Notwithstanding the above, for security reasons, FWP does not collect or store: (i) confidential cardholder data (such as all credit card numbers or card authentication data), (ii) instructor data, (iii) data about user accounts on other services, unless they are connected to the FWP account.
We use different international gateways to process charges for product sales, among others, which process all this information and by accepting the Policy you agree to share your information with the aforementioned payment gateways. FWP does not have access to credit card data.
FWP gives the User the option to add more information to their profile. The User may include a profile picture, a brief description, the country and city of origin, and their date of birth. What are Users' data used for?
FWP will use the information it collects to: (i) promote product sales; (ii) provide and coordinate with the User the information of the products they request; (iii) notify the User about changes in the Database; (iv) allow the User to participate in interactive features of the Database; (v) provide support to the User; (vi) validate the veracity of the information provided; (vii) update and consult contact data and other relevant information; (viii) attend to User queries and requests; (ix) manage User preferences regarding their accounts, (x) conduct statistical studies necessary to enhance FWP products and improve User experience; as well as trends and traffic, and track purchases and usage data. (xi) ensure compliance with information security protocols; among other purposes related to the service provided by FWP to the User; and (xii) facilitate the technical operation of services, which includes troubleshooting, service security and fraud and misuse prevention.
Unless otherwise stated in this section of the Policy, FWP will not share Personal Information with any third party without User authorization, unless it is necessary for the execution of the contractual relationship and for updates that may occur in the Database.
Likewise, User Personal Data will be used, including, but not limited to, in the following cases:
System administration: FWP may use User Personal Data for the purposes of administering its systems, assisting in diagnosing server problems, monitoring the performance and traffic of its systems, and gathering demographic information.
Communication and advertising: FWP will use Personal Data to periodically send the User, to their address, emails, announcements, offers and advertising about products offered in the Database. If the User manifests their consent for the sending of unsolicited advertising material, they will click on the check box "I expressly accept the sending of advertising and/or commercial material by FWP", which is located at the end of the Policy. Notwithstanding the above, if they accept the sending of advertising, but later wish to withdraw consent, the User may request to omit the sending of advertising through the email: [email protected].
Service providers: In the event that FWP decides to request the services of third parties in which User Personal Data is involved (for example, security services, payment gateway, data management and storage, call center, among others), FWP will transfer User Personal Data that is necessary for providers to carry out their services, whether to national or international service provider companies under the relevant regulations in order to safeguard their protection. In such case, the latter are obliged to maintain confidentiality regarding the information they have or may have access to, including their employees or providers. It should be noted that FWP will not be responsible for the obligations corresponding to Service Providers.
Other types of disclosure: Notwithstanding any provision to the contrary contained in this Policy, FWP reserves the right, and hereby, the User expressly authorizes FWP, to share their Personal Information or General Information: (1) in response to subpoenas, court orders or legal or administrative processes of any nature, or so that FWP can establish, protect or exercise its legal rights or defend against claims, administrative proceedings and investigations of any nature; (2) if FWP believes it is necessary to investigate, prevent or take action regarding potentially illegal activities, fraud, or situations involving potential threats to the safety of any person or property; (3) if FWP believes it is necessary to investigate, prevent or take action regarding significant abuse of Database infrastructure, denial of service attacks, or attempts to compromise information security; and (4) if FWP were to be acquired or merged with another entity, and in cases of corporate reorganizations, asset sales or bankruptcy.
Surveys: FWP may send the User, to their email and/or through text messages or any other available means, surveys about the services we provide through the Database, and/or about any other topic of interest to ensure service improvement.
By virtue of the above, FWP may transfer Personal Information nationally and internationally of Users for the purposes detailed in this point, for which Users provide their informed, prior and express consent.
Users may access, rectify, oppose and cancel their Personal Data ("Users' Rights"), as well as other rights granted by Law, which may be exercised through a request addressed to the following email: [email protected].
FWP's procedure in response to Users' Rights exercise by the User is subordinate to the provisions and deadlines established by the Personal Data Protection Regulatory Framework.
Notwithstanding the above, FWP may retain certain information of the User requesting cancellation, in order to serve as evidence in a possible claim against FWP for responsibilities derived from the processing of such information. The duration of such retention may not exceed the legal statute of limitations for such responsibilities.
If FWP entrusts the processing of personal data to a third party, or allows third parties access to its databases for the provision of a specific service ("Data Processors"), FWP will take into account the following specifications:
All processing of Personal Data carried out by a third party other than FWP must be regulated in an agreement with the Data Processors ("Agreement with Data Processors") that expressly establishes that the processing of Personal Data will be carried out following FWP's instructions and under the regulation of the Data Regulatory Framework. Likewise, FWP will establish with Data Processors that only Personal Data will be processed for authorized purposes or established in the contract, so the Data Processor will not use them for a different purpose, nor will they communicate them improperly to other persons.
The Agreement with Data Processors must stipulate the security measures that the Data Processor will be obliged to implement, such as the protection of Personal Data, the return or destruction of Personal Data, once the assignment is completed.
If the Data Processor needs to subcontract parts of the services it agreed to offer with third parties, it must have FWP's prior authorization, and this will only proceed provided that the subcontractor assumes the same obligations as the Data Processor.
The Agreement with Data Processors must also establish confidentiality obligations regarding the information accessed by the Data Processor, such obligations remaining in force even after the end of the contract term.
In accordance with the Personal Data Protection Regulatory Framework, FWP informs Database Users that the User's Personal Information will be incorporated into databases owned by FWP.
Databases will be stored through External Servers and the data retention time will be according to the purpose of storage. Notwithstanding the above, FWP is hereby authorized to retain certain information after fulfillment of the purpose; in order to serve as evidence in a possible claim against FWP for responsibilities derived from the processing of such information.
In this sense, through this Policy the User gives their express consent for the inclusion of their Personal Information in the mentioned databases.
FWP guarantees the protection of User Personal Data and prevents its alteration, loss, processing and/or unauthorized access, taking into account the nature of stored data and the risks to which they are exposed, all in accordance with the Personal Data Protection Regulatory Framework.
FWP employs various security measures to prevent unauthorized access, misuse or disclosure with technology and processes used in the industry. Notwithstanding the above, FWP is not responsible for illegal interceptions or violation of its systems or databases by unauthorized persons, as well as improper use of information obtained by such means, or any illegitimate intrusion that escapes FWP's control and is not attributable to it.
FWP is not responsible for possible damages or losses that may result from interference, omissions, interruptions, computer viruses, telephone failures or disconnections in the operational functioning of the electronic system, delays or blockages in the use of the Database, caused by reasons beyond FWP's control.
Similarly, FWP does not assume any responsibility for possible damages, fines or legal actions that may arise due to non-compliance with the obligations of External Servers contracted for the Database.
Additionally, the Database may contain links to other websites, however, it does not assume responsibility for the content of privacy policies and/or practices of other websites. When a User accesses a link that redirects them to another website, they must accept and abide by the privacy policy of said website.
Servers, providers and/or computers used by FWP to provide its services may be located outside the country or under other governmental jurisdiction. The User authorizes FWP to transfer, store and process their Personal Data internationally ("Cross-border Flow") in accordance with the provisions established in the Personal Data Protection Regulatory Framework, for which they manifest their prior, informed, free, express and unequivocal consent.
Each User is responsible for the veracity, accuracy, validity and authenticity of the information provided, and undertakes to keep it duly updated. Notwithstanding the above, the User authorizes FWP, if it deems pertinent, to verify the veracity of the Personal Data provided, through information obtained from publicly accessible sources or from specialized entities in the provision of such information, without it being considered an obligation to proceed with verification.
FWP undertakes not to disclose or share User Personal Data, without the User having given due consent for it, with the exception of information requests from authorities in the exercise of their functions and scope of their competencies; by virtue of court orders and/or legal provisions.
FWP uses the user's IP address to identify problems, administer the Database and identify traffic behavior patterns. Cookies or similar technology are also used to offer content according to your interests and to store your password so the User does not have to enter it again each time they return to the Database, it is important to mention that we use different types of cookies, data collection tools, profile analysis and online advertising.
Users declare to have read in advance and give their free, express, unequivocal and informed consent for FWP to process their Personal Data; likewise, they state that they have been informed about what information is collected, the way in which it will be done and the purpose of collecting Personal Data.
In the event that FWP collects and processes Personal Data of minors, necessary and essential for the development of the contractual relationship with the minor User; consent must be given by those holding parental authority or guardians, in accordance with the respective Personal Data Protection regulations.
FWP expressly reserves the right to modify and/or update this Policy at any time, according to regulatory modifications or requirements or due to service adjustments made at FWP's discretion.
Any modification and/or update produced in this Policy shall enter into force from its publication in the Database.
Likewise, FWP will make its best effort to notify Users of such modifications through their registered email or by making a publication in the Database.
The User expressly authorizes the assignment of this Policy and Personal Data in favor of any person who (i) is bound by this Policy; and/or (ii) is the new responsible for databases containing Personal Data.
After the assignment has occurred, FWP will have no responsibility with respect to any event that occurs from the date of assignment. The new database controller will assume each and every one of FWP's obligations established in this Policy regarding the processing, safeguarding and preservation of Personal Data.
The Policies are governed and interpreted in accordance with the laws in force in the Republic of Peru, subject to the competence and jurisdiction of the judges and courts of the judicial district of Lima, Peru.
FWP accepts all types of questions, complaints or comments regarding the Policies. The User must send an email to [email protected] or write to the following address: Av. Primavera N°2221, Int. 303, Urb. El Sausalito, Santiago de Surco district, province and department of Lima, Peru.
The User and in the case of minors, those exercising parental authority or guardians declare that, after having read the Policy, they expressly accept all the terms contained therein and also authorize FWP to send them advertising and/or commercial material. In sign of conformity, they proceed to fill out the visitor user purchase form.
